The Complaint/Investigation Process

Step l:  Complaint is filed with the Office of Professional Practices Services (PPS)
Step 2: Report is prepared and reviewed
Step 3: Either probable cause or no probable cause is recommended to the Commissioner

If no probable cause, case closed

If probable cause, complaint made to EPC

If a complaint is made to the EPC, the educator has twenty (20) days to respond in one of the following ways:

surrender certificate

bullet

contest allegations

bullet

request mitigation

bulletno response leads to default (Same as admission of guilt)

If educator decides to contest the allegations, request mitigations, or doesn't respond, hearings will proceed.

After the hearings, the Education Practices Commission makes the final order, which can be appealed to the District Court. Final order may be one, or a combination, of the following:

Revoke certificate

bullet

Letter of reprimand

bullet

Fine of up to $2000.00 per count/offense

bullet

Limit scope of practice

bullet

Deny issuance or endorsement

bullet

Conditional issuance of appropriate certificate

bullet

Probation

bulletStipulation or settlement agreement
